Agreement: nursery or out-of-school care
VVE:
Parent(s)/carer(s) truthfully declare that they are not entitled to childcare allowance in order to qualify for the municipal allowance.
Parent(s)/carer(s) are responsible for notifying us of any changes should this situation change.
Parent(s)/caregiver(s) agree to verification of entitlement to childcare allowance by the competent authorities.
Article 1
1. The contract between UniKidz and parents/carers is entered into with one of the parents/carers of the child (in this article: the ‘contract parent’).
2. In this respect, UniKidz's starting point is that:
a. Both parents/carers have parental authority over the child and the contract parent represents both parents/carers in the contract. The contract parent must ensure that all important matters concerning parental authority are coordinated with the other parent or caretaker;
b. If there is a difference of opinion between the parents or guardians about childcare at UniKidz, the contract parent must demonstrate, by means of a court ruling or divorce covenant, that the situation under a. does not apply;
c. If it turns out that the other parent is not charged with parental authority over the child, this parent is entitled under Article 1:377c of the Civil Code to information that ‘important facts and information concerning the person of the child or its care and upbringing’.
3. The agreement is concluded under the express condition that a copy of the placement agreement signed by the contract parent has been received by UniKidz. The signed agreement must be signed within 5 working days after it has been offered otherwise the reservation will expire. UniKidz will send a confirmation of receipt to the contract parent.
Article 2
The agreement ends by operation of law on the expiry date, without any notice of termination being required.
Article 3
Both parties are entitled to terminate this agreement (partially) prematurely without judicial intervention, either digitally via the parents' portal or by e-mail, subject to one month's notice.
Article 4
Before the start date of childcare, the agreement can be cancelled digitally via the parents' portal or by e-mail. The costs of cancellation will be a maximum of once the agreed monthly amount for childcare costs, depending on the time of cancellation:
- More than 3 months - €0.
- 1 to 3 months - €80,-
- Less than 1 month - the amount of the contractually agreed costs of one month of childcare
Article 5
UniKidz collects its invoice around the 27th of the month.
Article 6
The direct debit authorisations signed by the parent(s)/carer(s) must be delivered digitally signed to UniKidz at the same time as this agreement. As long as the direct debit authorisation has not been issued, the child will not be placed. Over the period of non-placement, the full cost of childcare remains due. The child will be placed as soon as the direct debit authorisation has been received by UniKidz.
Article 7
The prices in the agreement are based on the rates for the calendar year in which the first childcare is received. UniKidz reserves the right to unilaterally change its services, products and prices. Parent(s)/carer(s) are bound by these changes. No later than 1 calendar month, plus one week, before the change takes effect, the parent(s)/carer(s) will receive a statement with, for example, the new hours and the new rates.
Article 8
UniKidz offers childcare throughout the year, except for holidays. When determining the number of hours of care per month, the closing days are excluded. As a result, the actual number of hours to be provided may differ from the number of care hours stated in the agreement.
Article 9
The General Terms and Conditions of the Childcare Association and the house rules drawn up by UniKidz apply explicitly to this agreement and form an indissoluble whole with this agreement, as if they were literally included in it. The general provisions included in this agreement are an addition to the General Terms and Conditions and the house rules. By digitally signing this agreement, the parent(s)/carer(s) declare that they are familiar with and agree to the provisions of the General Conditions and House Rules and declare that they have viewed a copy of the General Conditions and House Rules digitally. UniKidz reserves the right to change the general terms and conditions and/or house rules. Parent(s)/carer(s) are bound to these changes. The house rules can be consulted in the parents' portal.
Article 10
Parent(s)/carer(s) remain responsible for keeping their personal details (address, telephone number, etc.) up to date. Any change in personal details must be reported to UniKidz immediately.
Article 11
UniKidz has taken out liability insurance for itself and for the staff, including trainees, as well as for the placed children. A collective accident insurance has also been taken out in the same way. These policies are available for inspection. Any liability of UniKidz concerning childcare is limited to the amount that will be paid in the case in question under UniKidz' aforementioned liability insurance and collective accident insurance.
Article 12
Changes in placement details requested by parent(s)/carer(s) are only valid if agreed in writing between the parties. Agreements with staff do not bind UniKidz unless they have been confirmed by it in writing. Except for the changed details, the other details/provisions of this agreement remain valid throughout the term of this agreement in order to bind both parent(s)/caregiver(s).
Article 13
The undersigned hereby authorises UniKidz until further notice to debit the costs for childcare from the specified bank and/or giro account on a monthly basis. The costs will be collected around the 27th of the month.
Article 14
As part of this agreement, the general terms and conditions and house rules of UniKidz are included below. With his/her agreement to this agreement, the undersigned declares to be familiar with and agree to the contents of the general terms and conditions and house rules.
Intermediate school care (TSO)
Intermediate school care (TSO) is a service provided by UniKidz and is not covered by the Childcare Act. Children are cared for at school or at a designated location during lunch time.
Article 1
1. The contract between UniKidz and parents/carers is entered into with one of the parents/carers of the child (in this article: the ‘contract parent’).
2. In this, UniKidz's basic principle is that:
a. Both parents/carers have parental authority over the child and the contract parent represents both parents/carers in the contract. The contract parent must ensure that all important matters concerning parental authority are coordinated with the other parent/carer;
b. If there is a difference of opinion between the parents/carers about UniKidz' between-school care, the contract parent must demonstrate, by means of a court ruling or divorce covenant, that the situation under a. does not apply;
c. If it turns out that the other parent does not have parental authority over the child, this parent is entitled, pursuant to Article 1:377c of the Civil Code, to information that is ‘important facts and information concerning the person of the child or its care and upbringing’.

Article 4

- More than 3 months - 0% of the monthly fee
- 1 to 3 months - 20% of the monthly fee
- Less than 1 month - the amount of the contractually agreed costs of one month of between-school care
Article 5
UniKidz collects its invoice around the 27th of the month.
Article 6
The direct debit authorisations signed by the parent(s)/carer(s) should be submitted digitally signed to UniKidz at the same time as the present agreement. As long as the direct debit authorisation has not been issued, the child will not be placed. Over the period of non-placement, the full costs of mid-day care remain due.
The child will be placed as soon as the direct debit authorisation has been received by UniKidz.
Article 7
The prices in the agreement are based on the rates for the calendar year in which the first between-school care is received. UniKidz reserves the right to unilaterally change its services, products and prices.
Parent(s)/carer(s) are bound by these changes. No later than 1 calendar month, plus one week, before the change takes effect, the parent(s)/carer(s) will receive a statement with, for example, the new hours and the new rates.
Article 8
UniKidz offers between-school care during the school weeks, with the exception of holidays and study days. When determining the number of hours of care per month, the closing days are excluded. As a result, the actual number of hours to be provided may differ from the number of hours stated in the agreement.
Article 9
a. Invoicing of between-school care takes place on the basis of the hours actually taken. An invoice will be drawn up depending on how many days you have under contract and how many are in the month in question.
b. School-free days announced in advance are not included in the invoicing. (Please note this does not apply to school trips, portfolio interviews or school closing early)
c. For childcare days that fall on a generally recognised public holiday, as mentioned in article 9d, you will not receive exchange and catch-up days or (financial) refunds.
d. This concerns the following generally recognised public holidays:
- New Year's Day
- Easter Monday
- King's Day
- Liberation Day (once every 5 years)
- Ascension Day
- Whit Monday
- Christmas Day and Boxing Day
Article 10
This agreement is expressly subject to the General Terms and Conditions of Intermediate School Care and the house rules drawn up by UniKidz, which form an indissoluble whole with this agreement, as if they were literally incorporated therein. The general provisions contained in this agreement are an addition to the General Terms and Conditions and the house rules. By digitally signing this agreement, the parent(s)/carer(s) declare that they are familiar with and agree to the provisions of the General Conditions and House Rules and declare that they have viewed a copy of the General Conditions and House Rules digitally. UniKidz reserves the right to change the general terms and conditions and/or house rules. Parent(s)/carer(s) are bound to these changes. The house rules can be consulted in the parents' portal.
Article 11
Parent(s)/carer(s) remain responsible for keeping their personal details (address, telephone number, etc.) up to date. Any change in personal details must be passed on to UniKidz immediately.
Article 12
a. Children making use of Intermediate School Care are also covered during Intermediate School Care by the accident and liability insurance taken out by the school. Any liability is limited to the amount that will be paid in the relevant case under the aforementioned liability and accident insurance taken out by the school.
b. UniKidz does not accept any liability for loss or damage to clothing or other property.
c. From the moment the child has reported to the TSO coordinator or one of the staff members, the child falls under the responsibility of Tusschool Care. At the end of the school day, the TSO transfers the child back to the school.
Article 13
Changes to the placement details requested by parent(s)/carer(s) are only valid if agreed in writing between the parties. Agreements with the staff are not binding on UniKidz unless they have been confirmed by it in writing. Except for the changed details, the other details/provisions of this agreement remain valid throughout the term of this agreement in order to bind both parent(s)/caregiver(s).
Article 14

Article 15

General Terms and Conditions for Childcare, Daycare, and Out-of-School Care - Version 2025
ARTICLE 1 – Definitions
In these General Terms and Conditions, the following definitions apply:
Start Date: The date agreed upon in the Agreement on which the Childcare begins.
Out-of-School Care: Childcare provided by a Childcare Center for children of primary school age, offering care before or after regular school hours, as well as on free days, afternoons, and during school holidays.
Daycare: Childcare provided by a Childcare Center for children up to the age at which they attend primary school.
Dispute Committee: The Childcare Dispute Committee.
Effective Date: The date on which the Agreement is concluded.
Childcare Center: A facility where Childcare takes place (excluding childminder care).
Childcare: The professional or non-gratuitous care, upbringing, and development support for children up to the first day of the month in which they start secondary education.
Entrepreneur: A natural or legal person operating a Childcare Center.
Parent: The blood relative or legal guardian, foster parent, or caretaker of the child receiving Childcare.
Parent Committee: An advisory and consultative body established by the Entrepreneur, consisting of representatives of parents whose children attend the Childcare Center.
Agreement: The childcare agreement between the Parent and the Entrepreneur.
Parties: The Entrepreneur and the Parent.
In Writing: This includes ‘electronic’ communication unless prohibited by law.
ARTICLE 2 – Applicability
These General Terms and Conditions apply to the Agreement between the Entrepreneur and the Parent.
ARTICLE 3 – Cancellation and Withdrawal
The Parent has the right to cancel the Agreement under the following conditions:
a. The Parent may cancel the Agreement from the Effective Date up to the Start Date.
b. If the Parent cancels less than one month before the Start Date, the Entrepreneur may charge cancellation fees up to a maximum of one month’s Childcare costs.
c. If the Parent cancels more than one month before the Start Date, the Parent may be required to reimburse already incurred costs.
If the Agreement is concluded remotely, the Parent has the right to withdraw under the following conditions:
a. The Parent may withdraw from the Agreement free of charge within fourteen days of concluding the Agreement.
b. If withdrawn before the Start Date, any payments made will be fully refunded. If withdrawn after the Start Date, costs will be calculated proportionally.
c. Withdrawal can be communicated in writing, optionally using the withdrawal form in Annex 2.
ARTICLE 4 – Placement Interview
The Entrepreneur invites the Parent for a placement interview before the Start Date.
During this interview, the following topics will be discussed:
- Specific details of the Parent and the child
- Acclimatization period
- Daily routine, nutrition, illness, medication, development
- Individual wishes of the Parent
- Communication
- Excursions, photo and video material
- Liability of the Parent
ARTICLE 5 – Duration and Renewal of the Agreement
The Agreement is concluded for:
a. Daycare: until the child turns four years old.
b. Out-of-School Care: until the child turns twelve years old.
Parties may agree on a shorter or longer duration.
Renewal of the Agreement must be agreed upon in writing and does not occur automatically.
ARTICLE 6 – Termination of the Agreement
The Agreement terminates automatically upon the expiration of the agreed period.
Additionally, the Agreement may be terminated early by either Party.
Termination is possible:
a. By the Parent with a one-month notice period.
b. By the Entrepreneur only for valid reasons such as payment arrears, severe disruption of the relationship, or economic necessity.
Termination must be made in writing.
ARTICLE 7 – Mutual Obligations
Both Parties ensure proper information exchange regarding the child.
Responsibility for the child is transferred as follows:
- For Daycare: The Parent is responsible when dropping off, the Entrepreneur when picking up.
- For Out-of-School Care: Agreements on pick-up and drop-off times are recorded in writing.
ARTICLE 8 – Obligations of the Entrepreneur
The Entrepreneur provides Childcare in accordance with the Agreement and legal regulations.
The care is performed with professionalism and appropriate materials.
The Entrepreneur considers individual wishes of the Parent as far as reasonably possible.
ARTICLE 9 – Obligations of the Parent
The Parent reports medical or developmental specifics at enrollment.
The Parent ensures the Entrepreneur has all necessary contact details.
The Parent complies with house rules and ensures timely drop-off and pick-up.
The Parent pays the agreed fee within the payment term.
ARTICLE 10 – Accessibility
The childcare facility is generally accessible to the child.
The Entrepreneur may deny access if care is deemed irresponsible, such as due to illness or safety risks.
ARTICLE 11 – Price and Price Changes
The agreed price is stated in the Agreement.
The Entrepreneur may change the price once per year and informs the Parent at least 40 days in advance.
The Parent may terminate the Agreement without notice in case of a price change.
ARTICLE 12 – Payment and Payment Arrears
The Entrepreneur provides a written invoice with a due date.
If payment is late, the Parent receives a reminder with a 15-day payment deadline.
ARTICLE 13 – Governing Law and Jurisdiction
The Agreement is governed by Dutch law.
Disputes may be submitted to the competent Dutch court.
ARTICLE 14 – Complaints Procedure
Complaints must be submitted in writing to the Entrepreneur and will be handled according to the internal complaints procedure.
ARTICLE 15 – Dispute Resolution and Legal Complaints Procedure for Childcare
Disputes between the Parent and the Entrepreneur regarding the formation or execution of the Agreement may be submitted by either Party to the Childcare Dispute Committee, Bordewijklaan 46, PO Box 90 600, 2509 LP The Hague, in accordance with the committee’s regulations (www.degeschillencommissie.nl).
ARTICLE 16 – Governance Code
The Entrepreneur adheres to the Childcare Governance Code, which can be found at www.kinderopvang.nl/governance and is available upon request.
ARTICLE 17 – Amendments
Amendments to these General Terms and Conditions must be mutually agreed upon by the Entrepreneur and the Parent.
ANNEX 1 – Further Provisions on the Obligations of the Entrepreneur (Article 8)
The Entrepreneur fulfills their obligations as stated in Article 8 by ensuring the following:
- A pedagogical policy plan that describes the distinctive approach to interacting with children and parents.
- Regulations on hygiene, safety, child abuse, medical procedures, illness, and privacy.
- A regulation governing the functioning of the Parent Committee.
- A complaints procedure.
Information on:
- Type of childcare, flexible care, and additional services.
- Group size and pedagogical ratios.
- Frequency and form of information exchange with parents.
- Nutrition and specific care agreements.
- Opening hours and service conditions.
- Picking up and dropping off the child.
- In the case of Out-of-School Care: participation in external activities, transportation, and care during holidays.
- The placement procedure and adjustment period.
- House rules of the Childcare Center.
- The applicable price and payment terms.
If laws and regulations change, the Entrepreneur ensures compliance.

ANNEX 3 – Reasons for Price Changes
Price changes may be influenced by:
- Labor costs, such as salaries, CAO increases, pensions, and sick leave expenses.
- Housing costs, such as rent, maintenance, and energy costs.
- Organizational costs, such as food, diapers, activities, transportation, IT, and administration.
- Financial situation, such as subsidies, occupancy rates, and general cost increases.
- Changes in laws and regulations that incur additional costs.
Price changes are customized and are not calculated using a fixed formula.
House rules UniKidz
- We treat each other with respect. No distinction is made based on background, culture, or appearance.
- Aggression and intimidation are not tolerated.
- Smoking is not permitted in or around our locations.
- Pets are not allowed within our locations (including outdoor spaces).
- Parents/guardians must follow the instructions of UniKidz staff at all times.
- Bringing personal toys is allowed at one's own responsibility and risk.
- UniKidz is not liable for damage, loss, or theft of children's belongings.
- Hot drinks may not be consumed in the group rooms.
Drop-off and Pick-up:
- At daycare centers, parents/guardians must wear overshoes, available at the entrance.
- Full-day daycare: Children can be dropped off between 7:30 AM and 9:30 AM. If arriving later or absent, parents/guardians must inform via the parent portal before 9:30 AM. Pickup is between 4:30 PM and 6:30 PM. Earlier pickup should be communicated at drop-off.
- Half-day daycare: Drop-off and pickup times are outlined in the location's pedagogical work plan. Due to the day structure and activity program, these times are more restricted. Absence should be reported via the parent portal.
- Out-of-School Care: On holidays and study days, children must be dropped off by 9:30 AM.
- At 6:15 PM, we allow time for a handover, as our center closes at 6:30 PM.
- Once a child is picked up, the parent/guardian is responsible for the child’s supervision.
- Parents/guardians receive a handover upon pickup, and the child is checked out by UniKidz staff.
- Coats should be put on and removed in the hallway to prevent disruption in the group room. Shoes should be placed in the (mobile) wardrobe and stored in a lice bag.
- If a child is to be picked up by someone other than the parent/guardian, this must be reported verbally or in writing. Children will not be released without prior notice.
- If a child is picked up late three times, an evening charge of €10 per child will apply.
- Absence due to illness or vacation should be reported via the parent portal. Returning after illness must also be communicated.
- The location access code may not be shared with third parties or trainees.
Parking:
- Bicycles should be neatly parked in designated areas.
- Cars should be driven slowly in the street.
- Cars must be parked in designated spots; double parking is not allowed.
Clothing and Accessories:
- Jewelry and accessories are not permitted.
- Clothing with drawstrings is not allowed.
- Coats, shoes, and bags should be labeled with the child’s name.
Indoor and Outdoor Spaces:
- Emergency exits and fire alarms must remain unobstructed. Strollers and car seats must be placed in designated areas.
- Bags and coats should not be left unattended and must be out of children's reach.
- Daycare sleeping rooms are not accessible to parents/guardians.
Exchange of Days:
- Child absences must be recorded in the parent portal.
- Exchanges are possible if staffing ratios and group size allow. No guarantee is given.
- If a child is deregistered at least 96 hours (4 days) in advance, exchange credit is granted, valid for 3 months.
- Exchange requests must be made at least two working days in advance.
- Daycare: Weekend requests for Monday will be processed Monday morning.
- Out-of-School Care: Weekend requests for Monday will be processed Monday afternoon.
- Holidays cannot be exchanged.
- A full-day Out-of-School Care session cannot be exchanged for two half-day sessions.
- If an approved exchange day is not attended, it expires.
- Sick days cannot be exchanged.
Privacy:
- UniKidz handles your and your child's data with care. No information about attendance or special care needs is shared with third parties without written consent unless child safety is at risk. The UniKidz privacy policy is available in the parent portal.
Photography and Filming:
- During registration and intake, parents are asked for consent regarding photography and filming.
- Consent may be withdrawn at any time by written notice. Previous use of images will not be reversed.
- Photos and videos are taken only by or on behalf of UniKidz; staff do not use personal devices.
- All images are handled with care and will not be shared in a way that could harm a child.
Holidays:
- To plan activities and staffing, parents must register absences via the parent portal.
- Without proper registration, we cannot accommodate exchange requests flexibly.
Study Days (Out-of-School Care):
- Schools schedule study days for teacher training, and UniKidz provides care on these days.
- If a study day falls on a child’s regular care day, no extra fee applies, but registration via the parent portal is required.
- If care is needed on a non-regular care day, additional charges apply.
Care in a Different Group:
- Exchange and extra days occur in the child’s usual group whenever possible.
- If no space is available, a child may be placed in another group, requiring prior written parental consent.
